DECISION & ORDER ON MOTION
Motion by appellant on an appeal from an order of the Civil Court of the City of New York, Kings County, entered July 28, 2009, for leave to reargue and renew a prior motion and cross motion to clarify a decision and order of this court dated October 25, 2011, which prior motion and cross motion were determined by decision and order on motion of this court dated September 4, 2013, or, in the alternative, for leave to appeal to the Appellate Division from this court's September 4, 2013 decision and order on motion, and for other alternative relief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
