STIPULATION OF DISMISSAL PURSUANT TO SETTLEMENT
Pursuant to Fed.R.Civ.P. 41(a)(1)(ii), Plaintiff's John S. Angen, Robert J. Houston, Melvin D. James, Thomas F. O'Brien, and Andrew O'Henley; and Defendants Chevron Corporation, Chevron Corporation Retirement Plan, Chevron Corporation Retirement Plan Trust, and the Trustee of the Chevron Corporation Retirement Plan Trust hereby submit this Stipulation of Dismissal Pursuant to Settlement, with the following provisions:
1. Plaintiff's John S. Angen and Robert J. Houston stipulate that all claims against Chevron Corporation; Chevron Corporation Retirement Plan; Chevron Corporation Retirement Plan Trust; and the Trustee of the Chevron Corporation Retirement Plan Trust are dismissed without prejudice, with each party to bear its own costs.
2. Plaintiff's Melvin D. James, Thomas F. O'Brien, and Andrew O'Henley stipulate that all claims against Chevron Corporation; Chevron Corporation Retirement Plan; Chevron Corporation Retirement Plan Trust; and the Trustee of the Chevron Corporation Retirement Plan Trust are dismissed with prejudice, with each party to bear its own costs.
3. This Court retains exclusive jurisdiction to enforce the parties' settlement(s) and/or to interpret the terms thereof.
