ORDER OF DISMISSAL

Maurice B. Foley, Chief Judge.

On August 23, 2021, respondent filed a Motion to Close on Ground of Duplication, therein asserting that this case is a duplicate of petitioner's case filed at Docket No. 11623-21. A decision was entered in the case at Docket No. 11623-21 on August 6, 2021. Respondent's motion states that petitioner does not object to the granting of his motion. As a decision has already been entered at Docket No. 11623-21, we will recharacterize respondent's motion and grant it, as recharacterized.

Upon due consideration, it is

ORDERED that respondent's Motion to Close on Ground of Duplication is recharacterized as a Motion to Dismiss on Ground of Duplication. It is further

ORDERED that respondent's Motion To Dismiss on Ground of Duplication is granted and this case is dismissed on the ground of duplication with Docket No. 11623-21.
