These consolidated cases are set for trial at the Special Trial Session of the Court scheduled to commence on May 1, 2023, in Washington, D.C.
On March 31, 2023, respondent filed with the Court a Motion for Leave to File Sur-Reply to Reply to Response to Motion for Partial Summary Judgment (Index No. 380 in Docket No. 23018-18 and Index No. 371 in Docket No. 23019-18), and concurrently therewith lodged a Sur-Reply to Reply to Response to Motion for Partial Summary Judgment (Index No. 381 in Docket No. 23018-18 and Index No. 372 in Docket No. 23019-18). Respondent informed the Court that petitioners object to the granting of the motion and to the filing of the sur-reply.
Upon due consideration, and for cause, it is
ORDERED that respondent's Motion for Leave to File Sur-Reply to Reply to Response to Motion for Partial Summary Judgment (Index No. 380 in Docket No. 23018-18 and Index No. 371 in Docket No. 23019-18), filed with the Court on March 31, 2023, is granted. It is further
ORDERED that respondent's Sur-Reply to Reply to Response to Motion for Partial Summary Judgment (Index No. 381 in Docket No. 23018-18 and Index No. 372 in Docket No. 23019-18), lodged with the Court on March 31, 2023, is filed as of the date of this order.
