An order of this Court having been entered on August 16, 2018 (M-2776), inter alia, granting respondent-appellant leave to appeal to this Court from the decision and order of the Appellate Term, First Department, entered in the office of the Clerk of the Supreme Court, New York County, on or about December 22, 2017, And the New York City Transit Authority having moved for leave to file a brief amicus curiae in connection with the aforesaid appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, without prejudice to renew, once the appeal is perfected.
