ORDER


After making an independent review of the pleadings, files, and records in this case and the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, I am of the opinion that the Findings and Conclusions of the Magistrate Judge are correct and they are adopted as the Findings and Conclusions of the Court. Accordingly, the third-party defendant's "Motion to Strike or Dismiss Third Party Complaint or, Alternatively, to Transfer Venue," filed March 1, 2002, is DENIED as moot; the third-party defendant's "Motion to Strike or Dismiss Amended Third Party Complaint or, Alternatively, to Transfer Venue," filed June 24, 2002, is GRANTED; and the amended third-party complaint is DISMISSED with prejudice.
