An appeal and cross appeal having been taken to this Court from an order of the Supreme Court, Bronx County, entered on or about February 25, 2020, and said appeals having been perfected,

And defendant-respondent-appellant having moved for an order (1) striking plaintiff-appellant-respondent's joint appendix; (2) directing plaintiff to properly serve and file a joint appendix and/or full record, together with a Stipulation of counsel for both sides specifying the contents thereof by a date certain; and (3) extending the time in which defendant is required to file a respondent's brief and record until this motion is decided,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of directing plaintiff, at his own expense, to file a supplemental appendix containing the materials set forth in paragraph 19 of defendant's affidavit in support of the motion, and adjourning the appeal to the March 2021 Term of this Court.
