Katia N. ALMAGEUR, Appellant v. Amelia IBARRA, Appellee

From the County Court at Law No. 9, Bexar County, Texas Trial Court No. 2022CV00660 Honorable Gloria Saldana, Judge Presiding

ORDER

REBECA C. MARTINEZ, CHIEF JUSTICE.

The clerk's and reporter's records were originally due on February 14, 2023, but neither was filed. On February 14, 2023, this court notified the county clerk and the court reporter that their respective records were late. Neither has responded to our notice. Also on February 14, 2023, this court notified appellant that her docketing statement was past due. To date, appellant has not responded to our notice of late docketing statement.

In light of the circumstances, we therefore ORDER that appellant provide written proof to this court that either (1) the clerk's fee has been paid or arrangements have been made to pay the clerk's fee; or (2) appellant is entitled to appeal without paying the clerk's fee by April 28, 2023. If appellant fails to respond within the time provided, this appeal may be dismissed for want of prosecution. See TEX. R. APP. P. 37.3(b).

We further ORDER appellant to provide written proof to this court by April 28, 2023 that the appellant has requested the court reporter to prepare the reporter's record, which request must designate the portions of the proceedings and the exhibits to be included. See TEX. R. APP. P. 34.6(b)(1). The reporter's record must be filed no later than thirty days after the date appellant's written proof is filed with this court. If appellant fails to request the record is writing, the court will consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(c).

All other appellate deadlines are SUSPENDED pending further order of this court.
