Feb 23, 2000
750 So. 2d 780 (Fla. Dist. Ct. App. 2000)

Opinion

No. 3D99-2507.

Opinion filed February 23, 2000.

An Appeal from a non-final order from the Circuit Court for Dade County, Eleanor Schockett, Judge, L.T. No. 99-2669.

Richard A. Sherman and Rosemary B. Wilder; Timothy W. Harrington, for appellant.

Nicholas G. Sadaka, for appellee Andrew Brodkin.

Before SCHWARTZ, C.J., and GODERICH and RAMIREZ, JJ.

We affirm the trial court's order denying the insurer's motion to dismiss and compel arbitration. The affirmance, however, is without prejudice to raise the issue of the set-off at the trial court.

Affirmed without prejudice.
