The reporter's record was originally due November 17, 2022 but was not filed. This court notified the court reporter of this deficiency by letter on November 29, 2022 and by court order on January 4, 2023 and January 25, 2023 delivered via U.S. mail and via email at david.laurel@yahoo.com. This court also forwarded copies of the letter and orders to appellant's counsel. On February 15, 2023, the court reporter filed a notification of late record stating: (1) he has not received a written designation of the record; and (2) appellant has not paid or made arrangements to pay the court reporter's fee for preparing the record and is not entitled to appeal without paying the fee.

We therefore ORDER appellant to provide written proof to this court by March 3, 2023 that appellant has requested the court reporter to prepare the reporter's record, which request must designate the portions of the proceedings and the exhibits to be included. See Tex. R. App. P. 34.6(b)(1). We further ORDER appellant to provide written proof to this court that either: (1) the reporter's fee has been paid or arrangements have been made to pay the reporter's fee; or (2) appellant is entitled to appeal without paying the reporter's fee by March 3, 2023. The reporter's record must be filed no later than thirty days after the date appellant's written proof is filed with this court. If appellant fails to respond within the time provided, appellant's brief will be due within thirty days from the date of this order, and the court will consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).
