DERRICK JEROME ALLEN v. WARDEN BURL CAIN, ET AL


In Re: Derrick Jerome Allen, applying for supervisory writs, 20th Judicial District Court, Parish of West Feliciana, No. 20797.

BEFORE: WHIPPLE, C.J., GUIDRY AND HIGGINBOTHAM, JJ.

WRIT DENIED. Relator has failed to present sufficient information and documentation about the nature of the suit, such as pleadings, to determine if provisions of the Prison Litigation Reform Act are applicable. Moreover, this Court has received information from the West Feliciana Parish Clerk of Court's Office that the minute entry of the May 22, 2013 hearing indicates a consent judgment would be submitted to the trial judge. Relator has failed to supplement the writ application with the current status of the suit in the trial court. Accordingly, this Court is unable to determine if relator's request for mandamus relief is moot.
