An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about May 11, 2023, and said appeal having been perfected, And defendant-respondent having moved to strike plaintiffs-appellants' Appendix for omitting critical exhibits and to dismiss their appeal, or, in the alternative, to compel plaintiffs-appellants to supplement the Appendix to include all exhibits filed in support of defendant-respondent's motion for summary judgment, and for related relief;
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of directing plaintiffs-appellants to file a supplemental Appendix containing Exhibits C through P to defendant-respondent's summary judgment motion dated January 27, 2023 (NYSCEF Doc. Nos. 220-233) for the April 2024 Term of this Court, to which term the appeal is adjourned; the motion is otherwise denied.
