This substantiation case was on the Court's June 12, 2023 Buffalo, New York trial calendar. We continued it a third time only on the parties' representation that they'd reached a basis for settlement at IRS Appeals. That settlement broke down, but the parties asked for a bit more time to try again to negotiate a settlement. Respondent recently reported that he's requested tax computations. The parties continue to believe this case is susceptible to settlement without the need for trial. They ask for a bit more time so it is

ORDERED that on or before August 2, 2024 the parties shall submit decision documents or file a joint status report describing their progress.
