Jose Mario ALEMAN, Appellant v. The STATE of Texas, Appellee

From the 381st Judicial District Court, Starr County, Texas Trial Court No. 21-CR-81 Honorable Jose Luis Garza, Judge Presiding

ORDER

LUZ ELENA D. CHAPA, JUSTICE

The reporter's record was originally due December 29, 2022, but it was not filed. On January 3, 2023, we notified the court reporter, Dora Canizales, the reporter's record was late. See Tex. R. App. P. 37.3(a)(1). On January 9, 2023 the court reporter filed a notice of late record, explaining appellant had not designated the record, but she did not request an extension of time. On February 6, 2023, the court reporter filed a second notice of late record, requesting a thirty-day extension of time to file the reporter's record, informing this court she had just received the designation of record.

After consideration, the request for an extension of time is granted. We order Dora Canizales to file the record by February 27, 2023. The court reporter is advised that the court will not grant a further extension of time unless she (1) establishes there are extraordinary circumstances that prevent her from timely filing the record, (2) advises the court of what efforts have been expended to prepare the record and the status of completion, and (3) provides the court reasonable assurance the record will be completed and filed by the requested extended deadline.
