The record was originally due on September 29, 2023. Appellant requested and was granted an extension of time to file the record until December 1, 2023. On December 1, 2023, appellant filed a second motion for extension of time to file the record until January 2, 2024. The clerk's record was filed on January 8, 2024. The reporter's record has not been filed.
On January 8, 2024, the court reporter Laura M. Cutherell filed a notice in this Court, stating that there was no reporter's record other than for a pretrial hearing and that no one had requested it. On January 19, 2024, court reporter Cutherell filed a notice that there was a reporter's record and that no one had made payment arrangements for the filing of the reporter's record. On January 24, 2024, the court reporter requested an extension of time, which the Court granted until February 23, 2024. On February 26, 2024, the Court issued an order directing the court reporter to file the reporter's record by March 27, 2024. On February 27, 2024, the court reporter advised that she was waiting on payment from appellant's counsel and that she believed she could file the reporter's record by March 22, 2024. This request for an extension is denied. The reporter's record is due on March 27, 2024.
The motion for extension filed by appellants on December 1, 2023 and requesting an extension until January 1, 2024 is denied as moot.
The reporter's record is due on March 27, 2024. If the reporter's record is not filed by March 27, 2024, the Court may require appellant to file a brief on issues or points that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).
