Court of Appeals of Texas, Fifth District, Dallas
Apr 27, 2009
No. 05-08-01567-CV (Tex. App. Apr. 27, 2009)

Opinion

No. 05-08-01567-CV

Opinion Filed April 27, 2009.

On Appeal from the 44th Judicial District Court Dallas County, Texas, Trial Court Cause No. TX-07-30563.

Before Justices MOSELEY, O'NEILL, and MURPHY.

MEMORANDUM OPINION

By letter dated April 9, 2009, this Court notified appellants that the brief they filed on April 9, 2009 did not comply with Texas Rule of Appellate Procedure 38.1. We directed appellants to file, within ten days, an amended brief that corrected the identified deficiencies. We further warned appellants that failure to file an amended brief that complied with the Texas Rules of Appellate Procedure would result in dismissal of the appeal. On April 17, 2009, appellants filed an amended brief. The amended brief, however, did not correct all of the deficiencies noted in the original brief. Specific deficiencies include appellants' failure to provide any citation to either the record or to authorities.

Accordingly, we strike appellants' brief and dismiss the appeal. See Tex. R. App. P. 38.8(a), 42.3(c).
