STIPULATION TO DISMISS PETITION FOR WRIT OF HABEAS CORPUS; AND ORDER


Petitioner, by and through his attorney of record, and respondents, by and through their attorneys of record, hereby stipulate, subject to the approval of the Court, as follows:

1. On September 27, 2002, petitioner filed and served a Petition for Writ of Habeas Corpus Under 28 U.S.C. § 2241.

2. Petitioner's case has been scheduled for a hearing before the Immigration Judge. Therefore, the parties stipulate to dismiss this habeas petition as moot.
