ALAMO CONCRETE PRODUCTS COMPANY AND ANTONIO HERNANDEZ, Appellants, v. JOSE ESPINOZA, Appellee.

On appeal from the 319th District Court of Nueces County, Texas.

MEMORANDUM OPINION

Before Chief Justice Contreras and Justices Hinojosa and Tijerina
Memorandum Opinion by Chief Justice Contreras

Appellants, Alamo Concrete Products Company and Antonio Hernandez, filed an appeal from a judgment entered by the 319th District Court of Nueces County, Texas, in cause number 2017DCV-4166-G. Appellants have filed an unopposed motion to dismiss the appeal on grounds that the case has been settled and a release of judgment has been signed, thus resolving the issues between the parties. Appellants request that this Court dismiss the appeal and tax costs against appellants.

The Court, having considered the documents on file and appellants' unopposed motion to dismiss the appeal, is of the opinion that the motion should be granted. See TEX. R. APP. P. 42.1(a). Appellants' motion to dismiss is granted, and the appeal is hereby DISMISSED. Costs will be taxed against appellants. See TEX. R. APP. P. 42.1(d). Having dismissed the appeal at appellants' request, no motion for rehearing will be entertained, and our mandate will issue forthwith.

DORI CONTRERAS

Chief Justice Delivered and filed the 21st day of November, 2019.
