On September 18, 2023, the parties submitted to the Court a Proposed Stipulated Decision (Doc. 15). The Proposed Stipulated Decision failed to address the I.R.C. § 6662(a) penalty determined in the June 24, 2022, Notice of Deficiency upon which this case is based. The Court will strike from the record the Proposed Stipulated Decision filed September 18, 2023, and permit the parties additional time to file a corrected and properly executed Proposed Stipulated Decision. Accordingly, it is hereby

ORDERED that the parties' Proposed Stipulated Decision filed September 18, 2023, is hereby stricken from the Court's record. It is further

ORDERED that, this case is stricken from the October 10, 2023, San Francisco, California, trial session, and the parties are excused from appearing at the calendar call on October 10, 2023. It is further

ORDERED that, on or before November 9, 2023, the parties shall file with the Court either a joint report (or, if that is not expedient, then separate reports) describing the status of the case or a stipulated decision document. It is further

ORDERED that the undersigned judge retains jurisdiction of this case.
