Victoria AGUIRRE, Appellant v. Lourdes Judith DE SANTIAGO WEBER, Appellee

From the County Court at Law No. 3, Bexar County, Texas Trial Court No. 2022-CV-00184 Honorable Cesar Garcia, Judge Presiding

ORDER

Liza A. Rodriguez, Justice

On April 21, 2023, Appellant filed a notice of appeal, stating her intent to appeal the trial court's March 23, 2023 Order on Motion for Summary Judgment. The clerk's record filed in this appeal does not include an order granting summary judgment by the trial court. The trial court clerk has informed this court that no such order has been signed by the trial court. As no final order has been signed by the trial court, it appears we lack jurisdiction over this appeal. See Lehmann v. Har-Con Corp., 39 S.W.3d 191, 192-93 (Tex. 2001) (explaining that when there has not been a conventional trial on the merits, a judgment is final for purposes of appeal only if it actually disposes of all parties and claims then before the court or if "it states with unmistakable clarity that it is a final judgment as to all claims and all parties").

We ORDER appellant to show cause on or before July 28, 2023 why this appeal should not be dismissed for lack of jurisdiction.
