It is Ordered that the motion of the tenant-appellant is granted on condition that tenant-appellant (1) perfect his appeal by no later than the June term, the filing deadline for which is April 12, 2017; (2) pays the petitioner the sum of $2,810.52, to the extent not already paid, representing use and occupancy arrears ordered by the Civil Court (Schneider, J.) pursuant to the Civil Court Order dated October 27, 2016, without prejudice. Said arrears are to be paid on or before January 13, 2017; (3) pays petitioner accruing use and occupancy in the amount of $900.00 per month, as agreed by the parties, on or before each subsequent rental due date, without prejudice. In the event of tenant-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move, on five days notice, for an order vacating the stay.
