JUDGMENT AGAINST DEFENDANTS' JOHN BROWN ASSOCIATES, INC.; JOHN A. BROWN, JR., AND KATHERINE BROWN
Having read and considered Plaintiff's Request for Entry of Judgment and all supporting pleadings and exhibits submitted therewith already on file with this court; and good cause appearing therefor,
JUDGMENT IS HEREBY ENTERED in favor of Plaintiff AGREXCO (USA) LTD. ("Agrexco") and against Defendants JOHN BROWN ASSOCIATES, INC.; JOHN A. BROWN, JR. AND KATHERINE BROWN, jointly and severally, in the principal amount of $34,000.00, all of which qualifies for trust protection under the trust provisions of Perishable Agricultural Commodities Act ("PACA") [ 7 U.S.C. § 499e, et seq.];
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the $34,000.00 sum under this judgment that qualifies for protection under the trust provisions of the Perishable Agricultural Commodities Act ("PACA") [ 7 U.S.C. § 499e, et seq.] is a non-dischargeable debt pursuant to Section 523(a)(4) of Title 11, United States Code;
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Agrexco shall be entitled to recover post-judgment interest at the rate of ten percent (10%) per annum on all sums due under this judgment until fully paid.
The Clerk shall enter judgment forthwith.
