MEMORANDUM OPINION
By letter dated November 6, 2009, this Court notified appellant that its brief was overdue. We directed appellant to file, within ten days, both its brief and a motion to extend time to file its brief. We further warned appellant that if it did not comply, we would dismiss the appeal without further notice. See Tex. R. App. P. 38.8(a)(1), 42.3. To date, appellant has not filed its brief or an extension motion. Accordingly, we dismiss the appeal.
