Petition for review granted; transferred to Court of Appeal, Sixth Appellate District

The petition for writ of mandate is ordered refiled as a petition for review. The petition for review is granted and the matter is transferred to the Court of Appeal, Sixth Appellate District, with instructions to vacate its order deferring petitioner's motion for stay for consideration with the appeal and to remand petitioner's matter to the Santa Clara County Superior Court for the limited purpose of conducting proceedings pursuant to Penal Code section 1170.95, and to grant any stay necessary to complete those proceedings. (See People v. Martinez (2019) 31 Cal.App.5th 719; Penal Code § 1260.)
