Order modified to recite that it is made upon the offer of the plaintiff to produce Pierault upon the trial, and as so modified affirmed, with ten dollars costs and disbursements. No opinion. Jenks, P.J., Thomas, Stapleton, Mills and Rich, JJ., concurred.
