RICHARD ACOSTA, JR, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 291st Judicial District Court Dallas County, Texas Trial Court Cause No. F21-25961-U

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

The clerk's record is incomplete because it does not contain a copy of the punishment jury charge and verdict or the trial court's judgment. The index to the supplemental clerk's record filed July 10, 2023, states it includes the "02/13/2023 Jury Charge-Punishment," but the document at that location in the supplemental clerk's record is "Defendant's Election of Punishment in Jury Trial." The supplemental clerk's record filed August 14, 2023, contains a copy of the trial court's certification of defendant's right of appeal, but it does not contain a copy of the trial court's judgment. The punishment jury charge and verdict and the trial court's judgment are not yet part of the clerk's record. Accordingly, pursuant to our orders of June 23, 2023, and July 21, 2023, we ORDER Felicia Pitre, Dallas County District Clerk, to file on or before AUGUST 31, 2023, a supplemental clerk's record containing copies of the punishment jury charge and verdict and the trial court's judgment.

We DIRECT the Clerk to send copies of this order to Felicia Pitre, Dallas County District Clerk; and counsel for all parties.
