ORDER

Adam B. Landy Special Trial Judge

On March 16, 2022, respondent filed a Motion for Summary Judgment. By Order served May 2, 2022, the Court directed petitioner and its counsel to file a response to respondent's motion on or before May 31, 2022. Petitioner failed to do so. Respondent's motion was assigned to the undersigned on June 9, 2022.

The Court held a conference call with the parties on July 14, 2022 to discuss the pending motion. Petitioner's counsel stated that petitioner had reached a basis for settlement in the case, and petitioner no longer desires to pursue the instant case. Petitioner's counsel also stated that the corporation no longer objects to the Court possibly granting respondent's motion.

Upon due consideration, it is

ORDERED that, on or before September 2, 2022, the parties shall either file (1) a Proposed Stipulated Decision, or (2) a joint Motion to Dismiss, or alternatively, (3) petitioner shall file a notice of non-objection to the Motion for Summary Judgment.
