Pending before the Court are Appellant's objection and motion to strike Appellee's reply brief and Appellee's response and alternative motion to strike Appellant's reply brief. Both motions are denied. Rule 38.7 permits the amendment or supplementation of a brief whenever justice requires and on whatever reasonable terms the court may prescribe. TEX.R.APP.P. 38.7. The Court exercised its discretion and filed Appellee's reply brief without requiring a motion for leave to file. The Court will determine when the case is submitted on the merits whether Appellant improperly raised new issues in its reply brief.
