ORDER

Before the Court are (1) appellee's motion for leave to supplement third amended appellee brief to address "inappropriate" citations to superseded pleadings in appellant's opening and reply briefs as well as an argument raised for the first time in the reply brief; (2) appellee's motion to strike from appellant's opening and reply briefs "the arguments, statements and allegations from superseded pleadings;" and, (3) appellant's responses in opposition to the motions.

We construe appellee's motion for leave to supplement as a motion for leave to file a sur-reply brief and GRANT the motion. The supplemental brief received August 25, 2020 is deemed a sur-reply brief and filed as of the date of this order. The parties are cautioned that no further briefing shall be filed unless requested by the Court.

We DENY the motion to strike.
