BY ORDER OF THE COURT.

Because the order on appeal dismisses a habeas petition, this court's order of September 21, 2012, dismissing this appeal for failure to pay the filing fee or submit indigency documentation is vacated and the appeal is reinstated. Nevertheless, the appeal is hereby dimissed as from an order not adverse to the appellant.
