Opinion

No. 518, 2011

01-24-2012

KIMBERLY ABBOTT,1 Petitioner-Appellant, v. DOUGLAS EDWARDS, Respondent, Appellee.

Court—Family Court of the State of Delaware, in and for Kent County File No. CK09-02658 Petition No. 10-41521

ORDER

This 24th day of January 2012, it appears to the Court that, on December 22, 2011, the Clerk issued a notice to appellant to show cause why this appeal should not be dismissed for her failure to diligently prosecute the appeal by not paying the Family Court appeal fee and transcript costs. The appellant has failed to respond to the notice to show cause within the required ten-day period; therefore, dismissal of this action is deemed to be unopposed.

NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Supreme Court Rules 3(b) and 29(b), that the within appeal is DISMISSED.

BY THE COURT:

Henry duPont Ridgely

Justice
