ORDERED that the decision and order of this court dated August 6, 2012 (36 Misc 3d 142[A], 2012 NY Slip Op 51505[U]), which determined an appeal from an order of the District Court of Nassau County, Third District, entered December 7, 2010, are recalled and vacated and a new decision and order substituted therefor (see Appeal No. 2011-685 N C, decided simultaneously herewith).
