Petitioner having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding, and having moved for other relief,

Now, upon reading and filing the affidavit of Jaan Aarismaa, IV sworn to February 11, 2013, the notice of motion with proof of service thereof, and the affidavit of Mark B. Wheeler, Esq., sworn to February 26, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve a brief is granted and petitioner may file a brief conforming to this Court's rules (see 22 NYCRR 1000.4 [f]) on the condition that the brief is filed and served on or before April 5, 2013, and the Clerk is directed to accept the brief for filing, and the motion is otherwise denied.
