DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from an order of the Civil Court of the City of New York, Kings County, entered June 30, 2015, and to vacate a stay granted by decision and order on motion of this court dated September 21, 2015 and extended by decision and order on motion of this court dated February 24, 2016. By order of this court dated May 23, 2016, the appeal was dismissed for failure to prosecute.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied as moot.
