MEMORANDUM OPINION
On December 16, 2008, this Court ordered appellant's counsel to file a brief by January 15, 2009. We further noted that the brief was already overdue and warned that failure to file the brief by the date specified would result in dismissal of the appeal. See Tex. R. App. P. 38.8(a). To date, appellant has not filed a brief. Accordingly, we dismiss the appeal for want of prosecution.
