This case is set for trial at the September 13, 2021, Trial Session of the Court where New York, New York is listed as the place of trial. Because all trial sessions are being conducted remotely, the place of trial is for administrative purposes only.
On August 20, 2021, the Court held a telephonic conference with the parties in this case during which time the parties indicated that they intend to file with the Court a Joint Motion For Leave To Submit Case Under Tax Court Rule 122, and a Stipulation of Facts. Also discussed was a scheduling Order.
After due consideration, and for cause, it is
ORDERED that this case is stricken for trial from the September 13, 2021, New York, New York trial calendar in that this case is continued with jurisdiction retained by this Division of the Court. It is further
ORDERED that the parties are directed to adhere to the following scheduling Order:
ORDERED that the parties shall, on or before August 30, 2021, file any pretrial memorandums for this case. It is further
ORDERED that the parties shall, on or before September 13, 2021, file a Joint Motion For Leave To Submit Case Under Tax Court Rule 122, and a Stipulation of Facts. It is further
ORDERED that the parties shall file their opening briefs, on or before December 13, 2021; and answering briefs on or before February 11, 2022.
