It is Ordered that the petitioner-respondent's motion seeking to vacate the stay granted by this Court, dated September 12, 2016, is granted, unless respondent-appellant: 1) perfects his appeal by no later than the March 2017 term - the filing deadline for which is January 11, 2017; and 2) pays the petitioner-appellant accruing use and occupancy in the amount of $2,800.00, the monthly rate set forth by Civil Court order (Stoller, J.), dated August 1, 2016, on or before each subsequent rental due date, without prejudice. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move on five days notice, for an order vacating the stay.
