February 4, 1938. In an action to procure a judgment declaring the nullity of an alleged void marriage upon the ground that on the date thereof the defendant was the lawful wife of one Joseph Maslo, who was then living and from whom defendant had never been legally divorced, judgment dismissing complaint reversed on the law, without costs, and judgment directed in favor of plaintiff for the relief demanded in the complaint. Findings of fact and conclusions of law inconsistent herewith are reversed
